But what is a fair increase?</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">There is no law (in England & Wales) on how much rents can be increased at any one time. Facebook posts providing ‘advice’ to tenants that their landlord can only increase it by a set figure or a set percentage are simply wrong. Any increase must however be ‘fair and realistic’, which is to say it is in line with average local rents i.e. the property’s value if it were to be re-marketed. If the tenant believes the increase is unreasonable, they can refer the matter to a (free) rent tribunal, which will then set the rent.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Conversely, it does irritate me a little when landlords say they want to increase it because their mortgage has gone up, or because of inflation, or simply by a nominal figure e.g. a £50pcm increase each year. This is especially unfair in my opinion if it is written into the tenancy agreement, rather than being properly calculated on the only thing that actually matters…how much that individual property is worth!</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Unless otherwise agreed between tenant and landlord, the rent cannot be increased for the first 12 months of a tenancy and it can then only be increased once a year (using a Section 13 notice). The tenants should be given at least one month’s notice before any increase applies.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Assuming tenants have looked after the property and paid their rent on time, I personally recommend meeting them half-way in regards to the amount of any rent increase i.e. keeping it slightly below market value to reward their good behaviour and incentivise them to stay longer in what is now their home.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Ultimately though, different landlords will have different thoughts on this; some will never increase the rent (thus not ‘rocking the boat’ so tenants stay longer; aware of the re-let costs and possible need for refurbishment if the current tenants leave), some will want the maximum rent at all times (likely seeing a higher turnover of tenants / risk of issues or resentment from tenants arising), whilst others take the middle ground.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">There are a couple of trains of thought when it comes to the timing of rent increases too; a set routine of annually reviewing the rent versus doing so on an ad-hoc basis (typically only increasing it when the current figure is out of kilter with the market). </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Even this can cause consternation amongst tenants though. Some prefer the ‘little and often’ approach, whilst others can actually do the math and realise even though a less frequent but greater increase may appear more painful, they are in fact better off this way. Let me explain with a real-life example…</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Tenants of mine had moved in at £800pcm. It was four years later when the market rent was £1,000pcm (having increased slowly for a few years and then suddenly in an 18-month period) that I decided to increase the rent for the first time to £900pcm. You might expect the tenants to be grateful they had received no increase for four years, or to appreciate that they were still paying significantly less than the market rate (having met them ‘half-way’). Instead, I was lambasted for ‘suddenly’ increasing the rent by £100pcm and was told by them that I should have done so by £25pcm each year instead to have softened the rise. Simple math says they were better off with my method, but I have been happy to change tact in subsequent years for this set of tenants so as to give them what they want i.e. a ‘smaller’ annual increase.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><img border="0" src="https://blogger.googleusercontent.com/img/b/R29vZ2xl/AVvXsEjTt_0ki53CUGCcHK11TUNpz7Emvc5wpX1lLxCJN36CUaNam5bWkYw0sDc_WykRe7zDwd-5sNZe33rA_ps6tbhGV0c5CzcmePIVPOX4fiHLvaBAhWzQbIeNCLmcyrcwA-senjl_0oALucCao98TyYe6961q88Lx3V0h0W7dHldkIHu6dvzuFi0YztafB1wI/w640-h336/4.png" /></div><div class="separator" style="clear: both;">I have come to learn that you aren’t necessarily doing your tenants a favour by not increasing the rent on a regular basis (I now typically review matters every 18 months). They can become ‘trapped’ in your property if they are paying well below market rate, as to move would see their rental payment increase dramatically. There are cases of families sticking with a property they have otherwise outgrown simply because they are currently ‘getting a deal’. There is also the shock if the landlord suddenly needs to sell the property as the tenants then realise they have been outpriced from the local rental market. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Ultimately, and especially with rents having increased so strongly over the past few years, tenants do expect rent increases throughout their time at a property. Previously I believed in not unduly increasing the rent if a tenant had paid on time each month and looked after the property. In fact, there were tenants of mine who had not received a rent increase for a number of years after moving in.</div><div><br /></div><div>This was all well and good when the average rent in the UK was increasing by just 2.4% per year (as was the case, on average, between 2015 and 2021), meaning the original rental figure did not become too far off the ‘going rate’. The fact is that the financial landscape for landlords has changed drastically. An increase in legislation and a change in the way landlords are taxed has increased costs. And then we have interest rates…which have massively increased the cost to any landlords with a mortgage.</div><div><br /></div><div>Now I’ll admit, when mortgage rates went down from around 6% in 2009 to 2% in 2020, I didn’t slash rents. But I did take into consideration that I did not <b>need </b>to increase rents because my mortgage costs were so low. This was a key reason I chose not to increase rents to good tenants during this period - a true win-win! Now that rates have reversed though, and with monthly mortgage payments suddenly doubling or even tripling, you cannot escape the fact that more income is required to counteract this i.e. rents need to go up. </div><div><br /></div><div>The alternative, which is one many landlords have taken, is to simply sell the property instead. This would result in the tenants both losing their home and facing much higher rents anyway on their next equivalent rental property when looking on the open market. </div><div><br /></div><div>But what about landlords without a mortgage - surely it is not necessary for them to increase the rent? Well, on the face of it perhaps not (although there are other costs that have increased), but there is also the opportunity cost to consider. Basically, if the rent is not increased, they will be getting a lesser return on their investment. When you consider they could sell up and stick the money in a savings account instead, which comes without the effort or associated risks of being a landlord, an increase in rent is necessary for it to remain worthwhile.</div><div><br /></div><div>So, it seems rent increases probably are now necessary for most landlords. It’ll also put people off when they come to view the property as it will make the rooms feel smaller and less inviting. Don’t forget the outside spaces either; make sure the frontage is clean and tidy, ready to make a good first impression. Tidying up the garden and creating a low maintenance space will make it more inviting, rather than looking like something tenants will have to be working on every weekend.</div><div> </div><div>Once the property is up to scratch and made to look its best, it’s time to call in the professionals and get it valued, photographed, measured-up and marketed. This has led to a hugely competitive market for wannabe tenants, whereby you can expect dozens of enquiries within 24 hours of listing a decent and well-priced property to rent. That is despite rents increasing across the board as a result of this supply and demand imbalance.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">On the face of it though, the supply of rental properties has at least ‘improved’ since a year ago (when just 82 properties were on the rental market in Chichester). But having just 98 homes on the market to rent in a city the size of Chichester is still wildly low. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">More worryingly however is that demand has continued to outgrow supply, as only 38% of rental listings are still available (with 62% let agreed), whereas this time last year 49% of listings were still available (with 51% let agreed). Bear in mind that four years ago (just before Covid struck) there were 205 properties on the rental market in Chichester, of which 143 (70%) were still available. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Clearly then there’s not much choice for those seeking a property to rent, which explains why so many people are enquiring as soon as something comes to the market. Furthermore, it explains why people are willing to pay more as and when something suitable does become available. The stick of taxation and legislation has proven too much for some, with interest rate rises wiping out profits for those with buy-to-let mortgages. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">I’ve written many times about the negative impact taxation and legislation changes are likely to have on the rental market; not only directly for landlords, but ironically for the tenants they are supposedly meant to help. This has now come to fruition as rental supply remains at such low levels that, unsurprisingly, rents are increasing as a result. That will see around 1.6 million households receive an average of £800 per year from April.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">At the same time, benefits in England and Wales are set to increase by 6.7%, whilst the minimum wage will rise from £10.42 to £11.44 per hour (a 9.8% increase).</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">This should therefore help tenants better afford their rental payments, especially towards the lower end of the market.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>More taxation - <span style="color: #38761d;">confirmed</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Someone has to pay for all the giveaways though! The Capital Gains Tax allowance is halving again to just £3,000 from April, along with Dividend allowances (halving to just £500). Meanwhile income tax thresholds have been frozen until 2028, meaning as incomes increase (due to inflation) more of it will be taxed at a higher rate. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">The unfairness of how Section 24 changed mortgage relief for landlords will also become more notable as incomes rise, the bandings are frozen and mortgage payments increase (without being able to fully offset them, whilst first paying tax on income rather than profit). </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>Energy efficiency requirements scrapped - <span style="color: #38761d;">confirmed</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">For the past few years, the Government have stated their intention to raise the minimum EPC rating to legally let a home from an ‘E’ to a ‘C’ (widely expected to come into effect for new tenancies from 2025 and all tenancies from 2028). </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">So it came as a big surprise last September when Rishi Sunak announced that plans to increase the minimum energy efficiency standard for rental properties in England and Wales had been scrapped.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Whilst it would be naïve to assume the policy won’t be back in some form in the future, it means that there are no longer lots of landlords panicking about how quickly they need to make potentially expensive improvements (many of which can actually be detrimental to a property).</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>House prices to drop - <span style="color: #f1c232;">likely</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">UK house prices ended 2023 down just 1.8%, which is a far cry from the house price crash many had expected in the face of an ongoing cost of living crisis and with interest rates at a 15-year high. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Nevertheless, further price falls are expected; albeit many now expect a more moderate fall that may last longer, before a recovery occurs.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>Interest rates to fall, yet mortgage payments to rise - <span style="color: #f1c232;">likely</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Interest rates have climbed rapidly over the past couple of years; between December 2021 and August 2023 the base rate rose from a historic low of 0.1% to that 15-year high of 5.25%. However, thanks to the Bank of England’s decision not to raise the base rate further since then, lenders have started to bring their mortgage rates down. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">With inflation expected to get back to its long-term target of around 2% in 2025-2026, we should see the Bank of England start to bring the base rate down in 2024, albeit perhaps only marginally. That should be enough though to encourage lenders that rates have peaked and to be able to offer more competitive deals this year; particularly to those seeking longer-term fixes.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Nevertheless, there are currently more than two million buy-to-let mortgages outstanding. Those on tracker mortgages will already have started feeling the pain of interest rate rises, </div><div class="separator" style="clear: both;">whilst those whose fixed-rate mortgages are set to expire will soon see a sharp rise in their monthly interest payments. It is anticipated that 144,000 landlords are set to come to the end of their five-year fixed deals in 2024. These landlords will have been on mortgages with rates of 2.5% or less, whereas the ‘new normal’ is set to see rates between 5% to 6%, meaning their interest payments will likely double overnight. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Landlords are also starting to realise that the past 15 years have been the exception rather than the norm and so higher mortgage rates (and higher monthly payments) are most likely here to stay.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>Rents to increase even more - <span style="color: #f1c232;">likely</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Landlords have sold almost 300,000 more homes than they've bought since 2016. Renters therefore face the harsh reality of there being too few homes available to let for too many tenants seeking accommodation. This, along with rising costs and greater taxation for landlords, led to a 9% increase in rents last year. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">In fact, over the past two years, the average rent on a newly-agreed tenancy has risen by more than 20%! Compare that to the period 2015 to 2019, whereby rents only increased by around 2.5% on average each year, and we can see the current trend is another exception rather than the norm.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">So, whilst the period of extremely rapid rent rises is probably now behind us, that fundamental supply and demand imbalance suggests rent increases will continue, but perhaps at a more moderate rate. Zoopla is forecasting rental growth of around 5% in 2024.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>Reduced profits - <span style="color: #e69138;">highly likely</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">According to Savills, landlord profits are at their lowest level since 2007 - a reflection of the fact that landlords are not profiteering by raising rents. Because, whilst rents have increased (and mortgage rates have fallen back in recent months), for those landlords with mortgages their payments are likely to become, if they haven’t already, far higher than in recent years.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">And with the majority of mortgaged landlords operating on interest-only mortgages, the hike in rates will see profit margins erode. Consider that the rate of a £200,000 interest-only mortgage rising from 2% to 6% will see costs jump from £333 to £1,000 per month. It would take a huge level of rental growth to compensate for this, far more than even the rapid rises we’ve seen over the past two years.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">A further sting in the tale for landlords are those Section 24 reforms, with some even finding they are making losses due to their tax bill being greater than their on-paper ‘profit’. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>Renters Reform Bill to be implemented - <span style="color: #f1c232;">likely</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">The long-awaited Renters Reform Bill is progressing through parliament, with expectations that it could pass law before the end of 2024. It is set to provide several key reforms for tenants, including periodic tenancies as standard, a new ombudsman to resolve disputes between landlords and tenants as well as penalties against landlords not adhering to a ‘Decent Homes Standard’.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">One glaring omission though is the ban on Section 21 notices (so called ‘no fault’ evictions). This was originally proposed in the 2019 Conservative Manifesto and formed a central pillar of the bill. However, it has now been delayed indefinitely due to the need to make changes to the court system to be able to properly implement its removal. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>A General Election - <span style="color: #e69138;">highly likely</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">A General Election must be called before the end of 2024 and held by the 28th January 2025. It is therefore highly likely it will occur this year, along with a lot of campaigning and political promises (most of which are likely to appeal to tenants as opposed to landlords).</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">This could lead to….</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;"><b>A change of Government - <span style="color: #f1c232;">likely</span></b></div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">The bookies put Keir Starmer as the clear favourite to be next Prime Minister and thus see Labour rise to power. That means all of the above could be amended in any which way they choose…and possibly for the worse.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">Angela Rayner became shadow housing secretary last September. On the face of it, you’d be right too. The average property in the UK twenty years ago cost £129,761, compared to £260,181 today. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">One of the buzz words of 2023 though seems to have been ‘inflation’, which may give you a little clue as to where I’m heading with this…</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">You see, Nationwide Building Society produces some fascinating house price data. Amongst them are the ‘UK house prices adjusted for inflation’ figures, in which Nationwide use the Office for National Statistics Retail Price Index (RPI) to convert the actual house prices into an inflation adjusted one. Doing so paints quite a different story for the UK’s housing market over the past two decades. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">For example, as mentioned earlier, a typical property twenty years ago (Q3 2003) would, on average, have cost £129,761 at the time. To buy the amount of ‘retail goods’ today that you could have bought then for that figure would now cost you £268,641 though i.e. more than the average UK home now costs (£260,181 as of Q3 2023). That is to say that overall inflation, measured via RPI, has increased more than UK house prices in the past twenty years.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">In theory then, property in the UK should feel ‘cheaper’ than twenty years ago (despite actually doubling in price). So why is it that not many people feel like that? </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">I believe that largely comes down to incomes not keeping pace with property prices. Add in a greater level of taxation and our net pay is even further adrift when it comes to housing ‘affordability’.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">That is, however, in contrast to the minimum wage, which has outpaced house prices over the past twenty years. Consider that the minimum wage was £4.50ph at the end of 2003 and is now £10.42ph. That’s a 132% increase vs the 100% increase in house prices over the same period. And the minimum wage is set to increase by another 9.8% next April…do you think property prices will increase by 9.8% next year? No? In which case, they should in theory become more affordable.</div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">You’ll note the chart below shows the inflation adjusted house prices as having fallen quite sharpish these past 18 months. That is because actual house prices have dropped a fraction in that time, whilst inflation in the same period has raced up by 17%. But with inflation having dropped to 3.9% in the year to November (and is close to zero over the past six months), change may be afoot. </div><div class="separator" style="clear: both;"><br /></div><div class="separator" style="clear: both;">As around 100,000 households a month continue to come off their (super cheap) fixed mortgage rates, it may be that interest rates hold the key here. Unlike when starting a tenancy there aren’t many legal requirements at this final stage of the tenancy, but there are a few things that should be done to help ensure it’s a smooth process.<span style="text-align: left;"> </span></div><p>Just like at the move-in, here at CRJ Lettings we use a checklist to ensure nothing gets forgotten. Final meter readings and a forwarding address for the departing tenants are taken, meaning the utility providers can receive the correct details so as to send the tenants their final bills. This should stop any debate over who owes what, as the date and meter readings will be documented for both parties (a copy of the checklist is both retained and provided to the tenants).</p><p>It’s then time to receive back the keys and check over the condition of the property. This is when it becomes so important to have had a thorough inventory (with photos) in place at the start of the tenancy. Most people’s memory simply isn’t good enough to remember every imperfection that existed (sometimes years before)! It also ensures the process is fair to the tenants; providing proof of any discrepancies, whilst ensuring they aren’t made responsible for something that wasn’t their doing.</p><p>My top tip for landlords would be to visit the property a few days before the move-out date to undertake a ‘pre-check’ with the tenants. This basically means inspecting the property and telling the tenants anything that might be an issue in regards to the full return of their security deposit.</p><p>This then gives the tenants an opportunity to remedy any issues prior to the actual move-out appointment. Assuming they take this advice on board, it’s good for me as I’ll be able to re-let the property promptly without having to arrange repairs. Moreover, it’s good for the tenants as they won’t have monies unnecessarily deducted from their security deposit (and if they don’t remedy the issues highlighted to them, they can’t say they weren’t warned or given the opportunity to make things right).</p><p>If there are any issues that remain when the tenants move-out (subject to fair wear and tear) this should be pointed out to them, noted and discussed in regards to the best way of resolving matters. The move-in process I created can be a pretty mundane hour or so of paperwork checking, contract signing and multiple page initialling! But, it’s crucially important that all the i’s are dotted and the t’s are crossed to ensure the tenancy gets off to the right start. Done properly, it will also mean a tenant is fully-equipped to enjoy their new home, whilst keeping it in good order for the landlord.</p><p>Here at CRJ Lettings we use a ‘move-in checklist’ to ensure nothing is missed; starting with the paperwork. The tenants sign the tenancy agreement (sent to them in advance so they can read it first), along with the security deposit certificate and prescribed information forms.</p><p>The tenants are then shown where the water stop tap, gas safety valve, fuse box and mains isolator switches are and what to do in case of an emergency. Showing tenants these is both crucial for their safety, as well as helping to minimise any damage to the property (for instance, in the case of a water leak). Meter readings are taken too and the tenants are shown any communal areas of the property, along with how the heating system and kitchen appliances work.</p><p>Just in case the tenants forget any of this important information though, they are provided with a house manual (prepared for our fully managed properties). This lists the location and operation of all the above, as well as setting out other general tips about good home management, along with all the contact details they’ll need throughout the tenancy. It also contains the property’s safety certificates and EPC, as well as the governments ‘How to Rent’ guide, as legally required (all of which are e-mailed to the tenants prior to the commencement of the tenancy).</p><p>The last bit of paperwork to go through is the inventory, which outlines the condition of the property and forms the basis of how it should be returned at the end of their tenancy. Fortunately, the tenants are given seven days to look through this beast of a document (typically 50+ pages) to report any errors or omissions.</p><p>Finally, the keys are distributed to the tenants and any other questions can be answered. Only once out of the first eight times that the minimum wage was raised did it increase by more than the house price growth for the same period, whereas since then it’s swung the other way; with nine minimum wage increases being above house price inflation, and seven falling short of this.</div><div class="MsoNoSpacing"><br /></div><div class="MsoNoSpacing">I was quite surprised to see that in the past ten years the minimum wage has in fact very nearly kept up with house prices; since 2013 the minimum wage has increased by 65% (from £6.31ph to £10.42ph), whilst house prices have increased by 66% (from £175,378 to £291,044).
